The BC Securities Commission is responsible for regulating the conduct of securities professionals, but it is up to you to recover your losses.

Q. I'd given up on ever seeing that money again. Is it too late to do anything now? A. Generally speaking, the limitation for claims in negligence is two years. In contract or for breaches of other duties to an investor, the limitation may be six to ten years. Timing in each case depends on the specific facts, but you should make an appointment to get legal advice as soon as possible.
Q. I don't want to spend a lot of money on legal fees. How much will it cost? A. An initial opinion is ordinarily not too expensive. We will tell you how much we think the opinion will cost ,based on what information you are able to provide, and what further work we will have to do, and we will honour that price. Depending on the facts of your case, talk to us about representing you on a "contingency" basis, where we will not bill you for legal fees unless your action is successful.
Q. If I win the lawsuit, will I recover my money? A. Most registrants under the Securities Act have some ability to pay. If you sue a member of the Vancouver Stock Exchange or the Investment Dealers Association of Canada, and they declare bankruptcy, you may be able to claim against the Canadian Investor Protection Fund.
Q. The Securities Commission report says my broker improperly traded my stocks. Will I get my money back? A. The Commission's finding can be very persuasive evidence that you have a right to be repaid, but it does not automatically mean you will be granted Judgment by a court.
