Marc Bolda Succeeds in Class Action against Eagle Ridge Pontiac Print E-mail

Marc Bolda succeeds on behalf of class action plaintiffs in negligent misrepresentation case against Eagle Ridge Pontiac GMA Ltd. regarding a Cashable Voucher Program.

The court in Payne v. Eagle Ridge Pontiac GMC Ltd. (please click on case name for full decision) has determined that Eagle Ridge Pontiac is liable for negligent misrepresentation to the class members regarding the legitimacy of the Cashable Voucher Program and the entity offering the vouchers and that any further decision must await further submissions from the parties and determination of individual issues.

These individual issues will be to what extent each class member may have relied on the negligent misrepresentation to their detriment, and, if so, what damages flow from that. Given that Eagle Ridge Pontiac has not appealed this decision, negotiations will now commence to see if a settlement can be reached on behalf of all class members, or whether further evidence needs to be gathered from class members and further submissions made to the court.
